Terms of Use & Participation Agreement

The Realtor Hive

Effective Date: May 7th, 2026

This Terms of Use & Participation Agreement (“Agreement”) governs access to and participation in The Realtor Hive platform, including its website, application, content, materials, community, programs, and related offerings (collectively, the “Platform”).

By creating an account, accessing the Platform, or submitting payment, you agree to be bound by this Agreement.

Eligibility & Participation

Access to the Platform is limited to authorized users who create an account and maintain valid login credentials.

This Agreement applies to all users of the Platform, including real estate professionals and mortgage professionals.

Intellectual Property Rights

All content, materials, systems, frameworks, workflows, templates, scripts, training materials, AI prompts, platform structure, and proprietary methodologies provided through the Platform are the exclusive property of The Realtor Hive.

Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use Platform materials for personal, non-commercial business purposes only.

No ownership rights are transferred under this Agreement.

Restrictions on Use

Users agree not to:

  • Copy, reproduce, modify, distribute, or resell Platform materials
  • Reverse engineer, deconstruct, or extract proprietary systems or frameworks
  • Create or operate a substantially similar coaching, education, or membership platform using Platform materials
  • Share, sublicense, or provide access credentials to any third party
  • Upload, store, or distribute Platform materials outside the authorized Platform environment

These restrictions apply during participation and for a period of two (2) years following termination.

Account Access

Each account is licensed to one individual only.

Users may not share login credentials or provide access to any other person, including assistants, teams, or organizations.

Unauthorized access may result in suspension or termination of access without refund.

Confidentiality

All non-public materials, internal systems, business structures, pricing information, and Platform methodologies are confidential.

Users agree not to disclose, distribute, or publicly share such information without prior written consent.

No Guarantees

The Platform provides educational, coaching, and informational resources only.

The Realtor Hive does not guarantee any outcomes, including but not limited to:

  • Business performance
  • Income or production levels
  • Listings or closings
  • Referrals or client opportunities
  • Financial results or return on investment

Individual results depend on personal effort, market conditions, and external factors beyond the Platform’s control.

Independent Responsibility

The Platform is not a brokerage, lender, employer, or advisory service.

Users are solely responsible for compliance with all applicable laws, regulations, and professional standards, including but not limited to:

  • State licensing laws
  • Brokerage policies
  • Federal and state advertising laws
  • MLS rules
  • Applicable federal regulations, including RESPA

The Platform does not provide legal, tax, or financial advice.

Realtor Member Terms

Realtor Members agree that:

  • Access is for personal professional use only
  • Materials may not be resold, redistributed, or rebranded
  • Login credentials must remain private and secure
  • Login credentials may not be shared.
  • One user per login.
  • Members may not use Platform materials to create competing systems or platforms

Mortgage Professional Participant Terms (if applicable)

9.1 Access & Term

Participation terms, pricing, and duration are set forth in the applicable invoice or written agreement. Unless otherwise stated, access is provided on a recurring or term-based basis as outlined at the time of enrollment.

9.2 Payment Terms

All payments are non-refundable unless otherwise required by law.

Failure to maintain payment may result in suspension or termination of access.

9.3 Confidentiality

Participation terms, pricing, and internal arrangements related to access are confidential and may not be disclosed without prior written consent.

9.4 Independent Business Activity

Mortgage Professionals are solely responsible for their own business operations, client interactions, marketing, and compliance obligations.

The Platform does not direct, control, or manage any user’s business activities or client relationships.

9.5 Use of Platform Information

Users may not use Platform data, materials, or membership information to directly solicit, market to, or contact individuals outside appropriate professional use and applicable permissions.

9.6 Remedies for Breach

In the event of a material breach of this Agreement, The Realtor Hive may suspend or terminate access.

The Realtor Hive may seek injunctive relief or other remedies available under law for misuse of confidential or proprietary materials.

9.7 Personal Guarantee (if applicable entity usage)

If participation is entered through a business entity, the individual executing the Agreement personally guarantees performance of all obligations under this Agreement.

No Referral Arrangement or Expectation

Participation in The Realtor Hive does not create any referral arrangement, referral obligation, or expectation of compensation between users.

The Platform does not request, require, or condition access, participation, or pricing on the exchange of referrals or business between any users, including mortgage professionals and real estate professionals.

All users are independently responsible for their own business decisions and professional relationships.

The Platform is provided solely for education, collaboration, and professional development purposes.

Indemnification

Users agree to indemnify and hold harmless The Realtor Hive, its owners, affiliates, and representatives from any claims, damages, liabilities, or expenses arising from:

  • Use or misuse of the Platform
  • Violation of this Agreement
  • Violation of applicable laws or regulations
  • Improper use of Platform materials

This obligation survives termination.

Limitation of Liability

To the maximum extent permitted by law, The Realtor Hive shall not be liable for any indirect, incidental, consequential, or punitive damages.

Total liability, if any, shall not exceed the total amount paid by the user in the twelve (12) months preceding the claim.

Termination

The Realtor Hive may suspend or terminate access at its discretion for violation of this Agreement or misuse of the Platform.

Upon termination, all rights granted under this Agreement immediately cease.

Governing Law

This Agreement is governed by the laws of the State of Texas.

Any disputes shall be resolved in the courts of Texas, unless arbitration is mutually agreed upon in writing.

Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

This Agreement constitutes the entire agreement between the user and The Realtor Hive regarding Platform access and supersedes all prior agreements or understandings.

Acceptance

By creating an account, accessing the Platform, or submitting payment, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
